Waqf Virtue and Purposes
Praise be to Allah, blessings and peace be upon his Prophet, his Kinsfolk and Companions
Having said that:
Waqf and Habs in language are synonymous words, it is said:
I made the property inalienable (habast) “i.e it is not for sale”, endowed the property (waqaft), and Withheld the property for charitable works (Awqaft).
This means to transfer the benefit of something owned to the beneficiary for a period of time, which could be a month, a year, or
in perpetuity.
The Malikis did not stipulate the waqf perpetuity, and this is considered a facilitation, exhortation, and expansion of the waqf.
On the other hand, the Hanafis, Shafi’is, and Hanbalis see that perpetuity is a prerequisite for the validity of the endowment.
